Terms of Use

BlowWater is operated by Cheung Pak Wai (“we”, “us”). These terms are the agreement between you and us. By creating an account or using the app, you accept them. If you don’t, don’t use the app.

What BlowWater is

An app for practising a language by chatting with other people who are learning too. We match you with people learning what you are learning, translate your messages as you send them, and turn what you said into study material. We are not a tutoring service and we don’t promise you will learn anything.

How old you have to be

You must be 18 or over. BlowWater is not for children, and we close accounts we find belong to someone under 18. Telling us an age that isn’t yours is a breach of these terms.

Your account

Give us accurate information and keep it accurate. One account per person. You are responsible for what happens under your account, so keep your sign-in secure. A username is yours while your account is; it is not property, and we may reclaim one that impersonates someone or breaks the rules below.

What you may not do

There is no tolerance for objectionable content or abusive behaviour. Accounts that post it are removed.

What happens when you break the rules

Anyone can report a person or a message from inside the app, and anyone can block another user at any time. We review reports and we act on them: we may remove content, restrict an account, hide it from other people, or terminate it. We can do any of this without notice, and we are not obliged to explain a decision in detail. If your account is terminated for a breach of the rules above, you may not create another.

Your content stays yours

You keep the rights to what you write and the photos you upload. You give us permission to store it, show it to the people you are matched with, and process it as described below, so the app can work. That permission ends when the content does. You are responsible for what you post, and you confirm you have the right to post it.

Translation and AI

To translate and correct your messages we send them to a third-party language model. That means the text of your messages leaves our servers; the privacy policy explains what is sent and to whom. Machine translation is often wrong, sometimes confidently. Don’t rely on it for anything medical, legal, financial, or otherwise consequential.

Credits and purchases

Some features use credits, bought through Apple’s App Store or Google Play. Credits are a licence to use a feature in the app. They have no cash value, cannot be transferred or exchanged for money, and expire if your account is closed. Purchases are handled by Apple or Google under their terms, and refunds are theirs to give. We may change what credits cost and what they buy; a change never takes away credits you have already bought.

Deleting your account

You can delete your account from Settings at any time, and it takes your profile and your messages with it. The privacy policy explains what is kept and for how long.

Availability

We may change, suspend or stop any part of the app. We try to keep it running and we don’t promise it always will be. The app is provided as it is, without warranties of any kind, to the extent the law allows.

Liability

To the extent the law allows, we are not liable for indirect or consequential loss, or for anything another user says or does. Nothing here limits liability that cannot legally be limited — including for death, personal injury, or fraud. If you are a consumer, you keep every right your local law gives you, and nothing in these terms takes those away.

Changes to these terms

If we change them we will update this page and the date at the top, and announce significant changes in the app. Continuing to use BlowWater after a change means you accept it.

If you got the app from Apple

These terms are between you and us, not Apple. Apple has no obligation to provide support for BlowWater and is not responsible for it or for any claim about it — including product liability, any failure to meet a legal requirement, or a claim under consumer protection or privacy law. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

Law and contact

These terms are governed by the laws of Hong Kong, and the Hong Kong courts have jurisdiction over any dispute. If you are a consumer elsewhere, this does not take away the protections of the law where you live.
